The following End User Licence Agreement or EULA is the legally binding contract setting rules concerning the use of Marble Run Simulator's construction sharing service : Marble Run Simulator Share Service, thereafter named "The Service".
The Service may be use while playing the game Marble Run Simulator, thereafter named "The Game".
The Service main functionality is sharing marble run circuits made in the Game, there after named "The Constructions".
The Service is used by you, a Marble Run Simulator's player whishing to share its constructions, thereafter nammed "The User".
Access to the Service must follow the acceptance of this EULA.
Tiaratum Games is the sole editor of the service Marble Run Simulator Share Service. Tiaratum Games is a registered company at the french registry of trade and companys (Registre du Commerce et des Sociétés), RCS 980 358 428, located at Talence, France.
Marble Run Simulator Share Service is hosted by OVH, located at 2 rue Kellermann, 59100, Roubaix, France.
The User of Marble Run Simulator Share Service may access at not cost the following features :
- Saving a construction made in Marble Run Simulator.
- Sharing the same saved construction via an url generated by Marble Run Simulator Share Service.
- Having saved construction displayed in the Showcase list of Marble Run Simulator.
The Service must be used only from a legally hosted version of the game Marble Run Simulator the user is rightfuly using, or a legally acquired version of the game Marble Run Simulator.
Tiaratum Games may use any technical or juridical mean at its disposal to limit access to the Service that does not respect this rule.
The game Marble Run Simulator is legally hosted on Poki.
The Service is provided at no additional cost. Any expanse required (hardware, internet access...) is supported by the User.
The User does not authenticate to Tiaratum Games to access the Service.
For any reason, access to the Service can be temporarily or permanently suspended by Tiaratum Games, without prior notice.
Tiaratum Games does not collect any personnal data about the user when he uses the service.
When sharing a machine he or she has created, the user is allowed to fill the 'author' field. Tiaratum Games does not connect the 'author' value to the user in any way (not with the ip, not with a session cookie, not with user-behavior detection). There is no way for a user to be the sole owner of a name or pseudonym sent via the 'author' field.
When sharing a machine he or she has created, the user is allowed to pick a flag indicating a 'country'. Tiaratum Games does not connect the 'country' value to the user in any way (not with the ip, not with a session cookie, not with user-behavior detection).
Third parties might collect personnal data while using the service (internet service provider, operating system owner, Marble Run Simulator game host), this EULA is not about theese data.
While using the service Marble Run Simulator Share Service, a cookie might be automatically installed on your computer.
Cookies are small files temporarily saved on the User's hard-drive.
Theese cookies are mandatory for the service to operate.
Theese cookies contain no personnal data and can not be used to identify an individual user.
By using the service, the user accept theese cookies.
The Service Marble Run Simulator Share Service allow the user to publish constructions he made in Marble Run Simulator, as a mean to save and share theese constructions.
By using the Service to share a construction made in Marble Run Simulator, the User grants Tiaratum Games licence to use the construction made in Marble Run Simulator.
This licence is worldwide, perpetual, irrevocable and transferable. This licence includes the right to own, edit and distribute the construction by any mean.
The user must follow the rules of Netiquette.
Tiaratum Games has a right of moderation over any publication and can edit or delete a publication, and has no obligation to provide a justification when doing so.
The present agreement validity duration is undetermined.
It starts when the User uses the Service.
The present agreement is redacted under french laws.
The inability to reach an amicable agreement in case of a dispute implies recourse to the competent French courts to settle the dispute.
